FOR THE PecanPoker.com SERVICE, OR BY USING OR ACCESSING
THE SERVICES PROVIDED BY PecanPoker.com, YOU ARE
AGREEING TO ALL OF THE FOLLOWING TERMS AND CONDITIONS.
IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS
AGREEMENT, YOU MUST SELECT THE "I DO NOT ACCEPT"
BUTTON AND YOU MAY NOT ACCESS OR USE ANY PART OF
THE SERVICE.
1. Binding Agreement. By registering for a MEMBERSHIP
account, participating in any tournament, or accessing
any services offered by the PecanPoker.com Service
or website (the "Service") you are agreeing
to be bound by the most current version of this
Agreement. Your PecanPoker.com account ("Account")
and all tournaments, games, and services at PecanPoker.com
web site or live tournaments are governed by this
Agreement.
1.1. Revisions to Agreement. If this Agreement
is revised, all revisions will be effective five
(5) days after the new Agreement is posted on PecanPoker.com
web site. It's the member's responsibility to review
the Agreement periodically, to become aware of such
revisions. You can view the Agreement at any time
by clicking on the Terms and Conditions link at
the bottom of the PecanPoker.com home page. Your
continued use of the Service for five (5) days after
a revised Agreement is posted on PecanPoker.com
will mean that you accept all such revisions. If
you don't agree to the changes or to any of the
terms in this Agreement, the sole remedy is to discontinue
use the Service and to cancel your Account. This
Agreement cannot be modified on an individual basis
by any person. If any portion of this Agreement
is revised without the approval of PecanPoker.com
it will be unenforceable.
1.2. Governing Law and Disputes. This Agreement
is governed by and is to be construed in accordance
with the laws of the State of Florida, irrespective
of any principles of conflicts of law. You agree
that any dispute that cannot be resolved between
the parties will be resolved individually, without
resort to any form of class action. You further
agree that any legal action arising from any dispute
will proceed only in the state or federal courts
located in Florida, and to submit to the personal
jurisdiction and venue in such courts for any such
action.
There are two types of Accounts for PecanPoker.com:
Guest Member and PECAN CLUB Member. The following
section describes the requirements and services
provided to members of each type of Account. Information
collected by PecanPoker.com is subject to our Privacy
Policy, which may be viewed from the link titled
Privacy Policy on the PecanPoker.com website.
2.1. Guest Member Account.
Guest Member Accounts are free, and you may take
part in all of the PecanPoker.com services available
to Guest Member Account members.
2.2 Registration.
You must provide the following information to register
for a Guest Member Account:
- Full Name
- Home Address
- Valid Email address
- Screen Name
- Password
- Phone Number
- Date of Birth
2.3 Eligibility.
To have a Guest Member Account, you must:
- Be at least 18 years old
- Be assigned to the e-mail address submitted
on your account registration form;
- Reside in a location that does not place restrictions
on your participation; this is to be solely determined
by person applying for membership.
- Abide by this agreement at all times.
2.4 Services.
Guest Member Accounts provide you access to the
limited services described here: Tournaments that
are listed as open for all members.
2.5 PECAN CLUB Member Account.
PecanPoker.com charges a subscription fee for Pecan
Club Accounts and provides additional products and
services that are not provided to Guest Member Account
members.
2.6 Registration.
In addition to the information required for a Guest
Member Account, you must also provide the following
information to register for a Power Member Account:
Billing address
Echeck or Credit card number
2.7 Eligibility.
To have a PECAN CLUB Member Account, you must:
- Be at least 18 years old
- Be assigned to the e-mail address submitted
on your account registration form;
- Members must physically reside in a state or
place that does not have restrictions on their
participation; this is to be solely determined
by person applying for membership.
- Abide by this agreement at all times.
2.8 Services
PECAN CLUB Member Accounts provide you access
to the products and services described here:
Products and Services. PecanPoker.com products
and services may change from time to time without
notice. The current list of products and services
will be listed at the preceding web page link.
2.9 Subscription Fees for PECAN CLUB Membership
Accounts.
In addition to the information required for a Guest
Member Account, you must provide the following information
to register for a PECAN CLUB Member Account:
- Credit Card Payment or Echeck . By registering
for a Power Member Account, you are authorizing
PecanPoker.com to charge the applicable recurring
PecanPoker.com Power Member Account membership
fees to your credit card or bank account. When
you provide credit card or banking information
to PecanPoker.com, you represent to PecanPoker.com
that you are the authorized user of the account
that you are providing. Each billing period that
you have a Power Member Account, you reaffirm
that PecanPoker.com is authorized to charge your
credit card or bank account for the Power Member
Account membership fee. You agree to promptly
notify PecanPoker.com of any changes to your banking
or credit card account number, its expiration
date, or your billing address, and you agree to
promptly notify PecanPoker.com if your credit
card expires or is canceled for any reason. You
are responsible for all charges incurred, including
applicable taxes, and all purchases made by you
or anyone that uses your Account, including your
family or friends. This means that, unless the
account or credit card information is obtained
unlawfully or fraudulently by someone other than
those authorized by you to use your account, you
will be responsible for all usage and purchases
on your Account.
2.10 Power Member Account
Fees are Payable in Advance and are non refundable.
Depending on the billing plan you choose, PecanPoker.com
fees are due on a monthly, quarterly, or yearly
basis. You are billed at the beginning of each applicable
billing period. If you do not cancel your Power
Member Account, then PecanPoker.com will automatically
renew your Power Member Account at the end of the
period, and you will be billed according to the
selected billing schedule. PecanPoker.com will provide
you with notice of any changes the fees or billing
methods at least thirty (30) days in advance by
posting such changes on PecanPoker.com web site.
You are responsible for reviewing the PecanPoker.com
web site to obtain notice of such changes. Your
continued use of the Service thirty (30) days after
our posting of billing or fee changes on PecanPoker.com
means that you accept these changes. If you decide
to cancel your Club membership, which you can do
at anytime up to five (5) days before the next billing
period without being billed for the next period,
we will not refund any fees accrued to your Account
before you canceled. If any change is unacceptable
to you, you may cancel your Account at any time
by email, effective at the end of your billing period.
PecanPoker.com will not refund any payments for
billing periods during which you had an active Account,
and we will not prorate fees for any Account.
2.11 Account Expiration.
PecanPoker.com may delete all Power Member or Guest
Member Account information you may have accumulated,
upon termination or expiration of a Power Member
Account, Or guest member account.
2.12 Free Trial Accounts.
If you accept a free trial Power Member Account,
we will begin to bill you for a Power Member Account
when the free trial period expires, unless you cancel
your Account before that time. You are always responsible
for any Internet service provider, telephone, wireless
and other connection fees that you may incur when
using PecanPoker.com, even when we offer a Free
Trial Account. Trial Accounts may not be transferred
at any time to any other user and are limited to
one person. You must provide credit card information
to register for a Free Trial Account. By signing
up for a Free Trial Account, you agree that PecanPoker.com
may obtain a pre-authorization on your credit card
of up to $20. Some financial institutions may perceive
these requested amounts as actual pending charges.
While not actual charges, PecanPoker.com is not
responsible for any results, such as an overdraft
fee, that may occur to your account because of pending
charges.
2.13 Taxes.
If your use of PecanPoker.com is subject to use
or sales tax, then PecanPoker.com may also charge
you for any such taxes, in addition to the Power
Member Account fees. Non US residents are subject
to back up withholding for federal income tax purposes
at 30%.
2.14 Limitations on Accounts.
You may not open more than one Account, and PecanPoker.com
may monitor any effort to establish multiple accounts.
If PecanPoker.com discovers that you have opened
more than one Account, then all additional Accounts
will be closed without notice and PecanPoker.com
may terminate all of your Accounts. PecanPoker.com
may void any winnings won during a time during which
you had multiple Accounts.
2.15 Accounts for Individual Use Only.
You, as the holder of your Account, are solely responsible
for all obligations and, assuming your compliance
with this Agreement, are entitled to receive all
the benefits as well. You may not allow any other
person to access your Account, access the Service,
accept any winnings, or participate in any tournament
using your Account. Your Account is not transferable
to any other person. You agree to indemnify, defend,
and hold PecanPoker.com harmless from or for any
claims, liability, damages, and/or costs (including
attorneys' fees) arising from any use of your Account
by any person.
2.16 Affiliate Program
Eligibility. To participate in the Affiliate Program,
you must be:
- 18 years of age or older, and A PecanPoker
member with an account in good standing. The Affiliate
Program cannot be used in conjunction with any
other PecanPoker offers or affiliate programs.
- Rules/Valid Referral. As an incentive to assist
PecanPoker in the recruitment of subscribers,
a PecanPoker member may receive 10% of total
monthly revenue generated by each new member brought
in through the Affiliate Program.
A Valid Referral occurs when:
- A "Valid Person" (as defined below)
is referred to PecanPoker through
's Affiliate Program, and
That Valid Person subscribes to a Power Member
Account with PecanPoker and
- That Power Member Account is maintained
for 30 consecutive days, on a non-trial basic,
and is in good standing. Any cancellation,
refund or chargeback may result in the consecutive
day period being reset.
A "Valid Person" must:
Be a new and unique customer to PecanPoker
,
Be over the age of 18,
Live in a valid state,
Not be registered with PEcanPoker.com under
any other name or alias,
Have submitted a valid email address,
Have submitted their full legal First and
Last Name,
Have submitted a complete valid mailing address,
Have accepted the PecanPoker Terms &
Conditions and continues to play within the
regulations of the Terms & Conditions
as they may be modified,
Have met all other qualifications to hold
a PecanPoker Power Member Account, and
Have used a credit card or banking information
that is not registered to more than two current
PecanPoker members. PecanPoker reserves
the right to determine at its sole discretion
whether a customer is a "Valid Person."
Affiliate Program Payment. Once a Valid Referral
has occurred, PecanPoker will deposit
10% of total monthly revenue generated into
the referring member's PecanPoker Affiliate
account. The Affiliate Program Payment will
not be considered a Prize under Section 4
of these Terms & Conditions.
2.17 Refer A Friend Program
Eligibility. To participate in the Refer A Friend
Program, you must be:
18 years of age or older, and
A PecanPoker member with an account in good
standing. The Refer A Friend Program cannot be used
in conjunction with any other PecanPoker offers
or Refer A Friend programs.
Rules/Valid Referral. As an incentive to assist
PecanPoker in the recruitment of subscribers,
a PecanPoker member may receive $10 Cash and
1,500 Poker Points for each new member brought in
through the Refer A Friend Program.
A Valid Referral occurs when:
A "Valid Person" (as defined below) is
referred to PecanPoker through PecanPoker
's Refer A Friend Program, and
That Valid Person subscribes to a Power Member Account
with PecanPoker and
That Power Member Account is maintained for 30 consecutive
days, on a non-trial basic, and is in good standing.
Any cancellation, refund or chargeback may result
in the consecutive day period being reset.
A "Valid Person" must:
Be a new and unique customer to PecanPoker ,
Be over the age of 18,
Not be registered with PecanPoker under any
other name or alias,
Have submitted a valid email address,
Have submitted their full legal First and Last Name,

Have submitted a complete valid mailing address,
Have accepted the PecanPoker Terms & Conditions
and continues to play within the regulations of
the Terms & Conditions as they may be modified,
Have met all other qualifications to hold a PecanPoker
Power Member Account, and
Have used a credit card or banking information that
is not registered to more than two current PecanPoker
members. PecanPoker reserves the right to determine
at its sole discretion whether a customer is a "Valid
Person."
Refer A Friend Program Payment. Once a Valid Referral
has occurred, PecanPoker will deposit $10.00
per Power Member referred into the referring member's
PecanPoker account as well as 1,500 Bonus Points
into their Player Points Account . The Refer A Friend
Program Payment will not be considered a Prize under
Section 4 of these Terms & Conditions. Current

Authorization. By entering a referral e-mail address,
you hereby authorize PecanPoker to use your
name to extend an invitation to the recipient of
that e-mail address to join PecanPoker . You
may refer as many friends as you would like. You
may refer each friend only once
2.18 Cancellation and Termination.
2.19 Cancel at Any Time.
You have the right to terminate or cancel your Account
at any time during the Support Hours (see Section
2.5(c) below).
2.20 Cancellation is Sole Remedy.
You understand and agree that the cancellation of
your Account is your sole right and remedy with
respect to any dispute with PecanPoker.com. This
includes, but is not limited to, any dispute related
to, or arising out of:
(1) any terms of this Agreement or PecanPoker.com's
enforcement or application of this Agreement;
(2) the content or services available through the
Service;
(3) your ability to access or use the Service; or
(4) the amount or type of fees, surcharges, applicable
taxes, billing methods, or any change to the fees,
applicable taxes, surcharges or billing methods.
2.21 How to Cancel.
You may cancel your Account by emailing us at admin@pecanpoker.com.
2.22 No Refunds.
Unless PecanPoker.com cancels your Account without
any reason, if your Account is terminated, suspended,
or canceled, no refund will be granted, and you
will have no further access to you Account or anything
within PecanPoker.com associated with it (such as
electronic messages, Player points, or tournament
tokens). Active Account holders may not allow former
Account holders whose Account was terminated by
PecanPoker.com to use their Accounts. Any delinquent
or unpaid Accounts, or Accounts with unresolved
issues with PecanPoker.com must be settled before
PecanPoker.com will allow you to register again.
3.1 PecanPoker.com Tournaments are not Gambling.
PecanPoker.com is not a gambling site -- you are
never asked to place a bet or risk money on a poker
tournament or any game. The Service's tournaments
are void if prohibited by the law in the jurisdiction
in which you are playing. You are subject to all
laws of the State or province and country in which
you reside and from which you access PecanPoker.com
and you are solely responsible for obeying those
laws. You agree that PecanPoker.com cannot be held
liable if laws applicable to you restrict or prohibit
your participation. PecanPoker.com makes no representations
or warranties, implicit or explicit, as to your
legal right to participate in any tournament offered
at PecanPoker.com, and no person affiliated, or
claiming affiliation, with PecanPoker.com has authority
to make any such representations or warranties.
3.2 Tournament Structure. Within the tournament
lobby of the software the tournament structure is
displayed for each individual tournament. Points
for all Power Members will be reloaded to an established
minimum amount each night.
3.3 Winner Notification, Verification and Requirements
3.3.1 Notification. Winners of tournaments will
be notified by email, and their Account will reflect
the prize that they won. PecanPoker.com is not responsible
for late, lost, or misdirected email notifications.
3.3.2 Verification. Winners will be required to
agree in writing to an Affidavit of Eligibility
and to provide their full name, address, city, state,
postal code, Social Security Number (or other acceptable
tax identification number) and date of birth (you
must be 18 on the date in which you played a tournament),
and, where lawful, a Liability and Publicity Release
within seven (7) days of notification, or winner's
prize may be forfeited. In order to be declared
a winner, Canadian residents may be required to
correctly answer a time-limited skill-testing question.
3.3.3 Additional People Not Eligible The following
people are ineligible to receive any prize offered
through the Service: employees, officers, and directors
(and their immediate family members) of PecanPoker.com
that work directly for PecanPoker.com, and any other
person with access to non-public information regarding
the operation of any tournament offered on PecanPoker.com.
"Immediate family members" are parents,
siblings, spouses, children, or any other person
permanently residing in the same household with
such employee, officer, or director. This section
does not prevent employees, officers, or directors
that work directly for PecanPoker.com from playing
on PecanPoker.com so long as such play does not
result in receipt of any prizes. For example, there
may be promotions such as "Catch a Fish,"
in which PecanPoker.com owners or associates participate
in tournaments and the Player that knocks them out
will receive any prize money for the place in which
the Fish was knocked out.
3.3.4 Winners of a seat into a tournament (i.e.
World Series of Poker Main Event) must actually
utilize the seat and play in the tournament, subject
to the mandates of the PecanPoker.com, including
but not limited to the requirement that each winner/participant
must wear PecanPoker.com attire provided to the
participant and make themselves available for interviews
and other promotions as determined at the sole discretion
of PecanPoker.com.
4.1 Claiming Prizes. PecanPoker.com will transfer
any cash prizes to the member's Moneybookers.com
account, after a Winner requests to cash-out his/her
prizes and PecanPoker.com has received the winner's
completed Affidavit of Eligibility and, where applicable,
the Liability and Publicity Release. See Cashing
Out process for more details regarding the prize
claim process. You must have at least $50 in real
money before cashing out. A minimum of two times
per year, PecanPoker.com will provide an opportunity
for members with less than $50 in their Accounts
to cash out their Accounts.
4.2 Taxes. In compliance with United States Internal
Revenue Service regulations, any person who wins
more than $600 (USD) at PecanPoker.com in any given
year must complete an affidavit of eligibility that
includes an IRS Form W-9. PecanPoker.com will send
an IRS Form 1099 or other appropriate form to such
person. If a person does not provide a signed W-9
by January 15 of the year following the year in
which he or she won $600 or more, then such winner
may forfeit their winnings. Depending on the jurisdiction
in which you reside, PecanPoker.com may also send
you additional similar tax forms. You remain solely
responsible for paying all federal and other taxes
in accordance with the laws that apply in your state,
province, and/or country of residence.
4.3 Unclaimed Prizes will not be awarded. Return
of any prize or prize notification as undeliverable
may result in forfeiture of the prize. If a Prize
is not claimed, or if the winner is ineligible or
does not provide eligibility verification, then
the prize will not be awarded.
4.4 Chances of Winning. The chances of winning a
prize will depend on the number of entries in the
particular tournament.
4.5 List of Winners. A list of winners is available
upon request to PecanPoker.com.
5.1 Game Play. The Service tournaments are governed
by the rules of No-Limit Texas Hold'Em Tournaments.

5.2 Fair Play. Your play in each tournament is
governed by the following standards of conduct.
If you break any standard, then you will be disqualified
from the tournament, and your Account may be suspended
or terminated.
5.3 No Automated or Programmed Participation. Any
attempt to participate in any tournament hosted
or sponsored by PecanPoker.com by means of automatic,
macro, programmed, or similar methods, or to otherwise
commit fraud with regard to the tournaments, may
result in active pursuit of civil litigation and/or
criminal prosecution, termination of your Account,
and forfeiture of all prizes to which you might
otherwise be entitled.
5.4 Software Modifications. You cannot attempt
to modify, decompile, reverse-engineer or disassemble
the PecanPoker.com Software in any way.
5.5 Collusion. Collusion between Players by sharing
hole cards or by any other methods is strictly forbidden.
Because collusion is a violation of this Agreement,
PecanPoker.com may suspend or terminate your Account
if you engage, or attempt to engage, in collusion,
notwithstanding the effect of such an attempt. PecanPoker.com
may, in addition to other measures, restrict seating
or prohibit Players from playing at a particular
poker table or in a tournament, including restricting
two or more Players from playing together at the
same table or in the same tournament.
5.6 Zombies. If you are registered for a tournament,
but do not log in and play a hand for 25 consecutive
hands or the end of the first blinds Level, whichever
is earlier, of that tournament (being a "Zombie"),
you will be disqualified from the tournament. Players
that are disqualified are not eligible to win a
prize.
5.7 Chip-Dumping. Chip-dumping occurs when a Player
intentionally loses a hand for the purpose of deliberately
transferring his chips to another Player. PecanPoker.com
may suspend or terminate your Account if you engage
in chip-dumping. Additional penalties may be imposed
and PecanPoker.com may withhold all prizes including
cash.
5.8 Other. If PecanPoker.com determines that you
have engaged or attempted to engage in fraudulent,
unlawful, dishonest or improper activity while participating
in PecanPoker.com tournaments, including without
limitation, engaging in any of the activities set
forth above or any other game manipulation, PecanPoker.com
may take such action as it sees fit, including immediately
suspending, or terminating your Account, or taking
legal action against you.
5.9 Right to Cancel. If PecanPoker.com determines,
in its sole discretion, that operating or concluding
a tournament is not feasible for any reason, including
without limitation, any of the reasons set forth
in this section, then PecanPoker.com may cancel
such tournament.
5.10 Technical Issues. If technical difficulties
compromise the integrity or ability to continue
registration or play, PecanPoker.com reserves the
right to terminate the tournament.
5.11 Computer, Internet, or Other Technology Failures.
PecanPoker.com is not responsible for any error,
omission, interruption, deletion, defect, or delay
in operations or transmission; theft or destruction
or unauthorized access or alterations to the Service,
computer transmissions, or for technical telephone
equipment, electronic, hardware or software, network,
Internet, or computer malfunctions of any kind;
or inaccurate transmission of, or failure to receive
information by PecanPoker.com on account of technical
problems or traffic congestion on the Internet.
PecanPoker.com is not responsible for sever or hosting
failures.
5.12 User Technology. PecanPoker.com is not responsible
for technical, hardware or software failures of
any kind, lost or unavailable network connections,
or failed, incomplete, or delayed software transmissions
that limit your ability to participate, or damage
your system as a result of participation, or downloading
any information necessary to participate in the
tournaments. Minimum Players. PecanPoker.com reserves
the right to terminate or cancel a tournament if
such tournament does not have the minimum number
of users registered to participate.
5.13 Rules Interpretation. This Agreement, the
official rules, and enforcement of the standards
of conduct, will be interpreted in PecanPoker.com's
sole discretion, and all determinations made pursuant
to these rules by PecanPoker.com are binding and
final.
5.14 Limitation of Liability. PecanPoker.com is
not responsible for conditions caused by events
beyond their control that cause the Service to be
disrupted or corrupted; any printing or typographical
errors in any materials associated with the Service
or the entry process; any software or technical
errors or bugs associated with the Service.
5.15 Sponsor. The Sponsor of all PecanPoker.com
tournaments is available upon request.
5.16 Release. All participants agree to release
and hold PecanPoker.com, its parent, subsidiaries
and affiliated companies, and the employees, officers,
directors, shareholders, agents, representatives
of PecanPoker.com its parent, affiliates, subsidiaries,
advertising, promotion, and fulfillment agencies,
and legal advisors, harmless from any and all losses,
damages, rights, claims and actions of any kind
in connection with the Service, the entry process,
and claims based on publicity rights, defamation,
or invasion of privacy.
6.1 PecanPoker.com Owns the Service. By accepting
these terms and conditions you acknowledge that
all information contained at PecanPoker.com may
be protected, in all forms and media, by one, but
not limited to valid patents, copyrights, trade
secrets, trademarks, or other proprietary rights,
and that all such rights are owned by PecanPoker.com
or its licensors. You may not modify, publish, participate
in the transfer or sale of, create derivative works
from, or in any way exploit this information, except
as permitted by law, such as under fair use. While
we use all efforts to include accurate and up-to-date
information, PecanPoker.com makes no warranties
or representations as to its accuracy. PecanPoker.com
does not assume liability or responsibility for
any errors or omissions in the content of the Service.
6.2 Trademarks. The trademarks, logos, and all
other content are considered the "Trademarks"
displayed on the Service are registered and unregistered
Trademarks of PecanPoker.com or others. Nothing
contained on the Service should be construed as
granting, by implication, estoppels or otherwise,
any license or right to use any Trademark displayed
on the Service without the written permission of
PecanPoker.com or such third party that owns the
Trademark displayed on the Service. Misuse of Trademarks
displayed on the Service, or any other content on
the Service, except as provided in this Agreement,
is strictly prohibited. In doing so be advised that
PecanPoker.com will enforce its intellectual property
rights to the fullest extent of the law, including
pursuit of criminal prosecution or civil litigation
where appropriate.
6.3 User Communication. All communication or material
you transmit to PecanPoker.com by electronic mail
or other, including any data, questions, comments,
etc. is and will be treated as, non-confidential
and non-proprietary. Anything you transmit or post
may be used by PecanPoker.com or its affiliates
for any purpose, including, but not limited to,
broadcast, posting, reproduction, disclosure, transmission,
and publication. Furthermore, PecanPoker.com is
free to use any ideas, concepts, know-how or techniques
contained in any communication you send to PecanPoker.com
for any purpose whatsoever including, but not limited
to, manufacturing, developing and marketing products
using such information, without additional compensation
to you.
7.1 Code Of Conduct. It is PecanPoker.com's desire
to maintain a friendly environment for its players.
While PecanPoker.com is not responsible for the
conduct of any player, PecanPoker.com does reserve
the right to refuse, suspend or revoke its Service
if PecanPoker.com believes a player is in violation
of the PecanPoker.com Code of Conduct ("Code
of Conduct"). A violation of the Code of Conduct
may include, without limitation, any the following
actions:
7.1.1 Collusion or cheating with another Player
of any form
7.1.2 Agreeing to take any action when there is
another Player all-in.
7.1.3 Revealing a Player's down cards before a
hand is complete.
7.1.4 Needlessly stalling the action in a game.
7.1.5 Selling or dumping play chips or PecanPoker.com
points for cash.
7.1.6 Attempting in any way to induce a Player
to leave a game to play in another.
7.1.7 Verbally threatening any Player or employee
of PecanPoker.com.
7.1.7 Using profanity or obscene language.
7.1.8 Making statements that could unfairly influence
the action in a game.
7.1.9 Chatting in any language other than English
during game play (trivial exceptions will be made)
7.1.10 Begging other Players for play chips or
PecanPoker.com points.
7.1.11 Advertising websites or other commercial
services.
7.1.12 Typing words, characters or phrases that
make it difficult for others to use the chat feature
[flooding, abusive content, player abuse or any
content deemed inappropriate by PecanPoker.com].
7.1.13 Spamming tables with announcements of private
tournaments or sit-and-go events.
7.1.14 Coaching Players or suggesting how others
should play their hand with respect to another Player's
hands; or transmitting any data, conversation or
any other information that may be interpreted as
defamatory, offensive, slanderous or rude.
7.1.15 PecanPoker.com reserves the right to make
decisions in the interest of fairness and the Player's
previous chat history with PecanPoker.com. The decision
of PecanPoker.com is final. In the event a Player
is reporting a violation of the Code of Conduct,
please include the table and hand numbers to indicate
when and where the violation or problem took place.
YOU AGREE THAT PecanPoker.com IS NOT RESPONSIBLE
FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING
FROM USE OF THE SERVICE, OR DAMAGE, LOSS, OR INJURY
RESULTING FROM USE, ACCESS, OR ATTEMPTED USE OR
ACCESS OF THE SERVICE. YOU FURTHER AGREE THAT PecanPoker.com
IS NOT LIABLE FOR DAMAGE, LOSS, OR INJURY CAUSED

Gifts shall mean any non-cash item, which can be
either physical or virtual (electronic format).
10.1 Any gifts offered by third parties are delivered
directly to the members's postal address by the
party making such offers and PecanPoker.com accepts
no liability or offers no warranty to any aspect
of such transactions.
10.2 When points are redeemed for gifts, the transaction
is solely between the vendor of the gift and the
member. You will indemnify PecanPoker.com from any
disputes arising out of such transactions.

to ensure that the gifts offered are of good quality,
no warranty is made to the quality, suitability,
delivery times, condition, physical attributes or
any other aspect of that gift.
10.4 Where indicated, a delivery charge may be applicable
